A SETTLEMENT has been reached in the lawsuit brought by Professor Dr. Md Nasir Ibrahim, the former chief executive of the National Film Development Corporation Malaysia (Finas), over his alleged unlawful termination.
According to Free Malaysia Today, the case was resolved through a consent judgement before High Court judge Roz Mawar Rozain.
All defendants, except Communications Minister Fahmi Fadzil, have agreed to issue a press statement clarifying that Nasir Ibrahim was not dismissed due to misconduct. The statement will also express Finas’s appreciation for his contributions during his tenure.
As part of the settlement, Nasir will withdraw his lawsuit in exchange for an undisclosed amount of compensation, with no order to costs.
His lawyer, A. Srimurugan, confirmed the agreement.
Counsel Nasbal Harun represented Finas, its board chairman Kamil Ahmad Othman, and directors Mastura Ahmad Mustafa, Idwan Ariff Abdul Rahman, and Noor Azam Shairi, while senior federal counsel Zairani Tugiran appeared for Fahmi.
Nasir had been appointed as Finas CEO on a two-year contract starting November 1, 2021, but his contract was terminated prematurely, effective June 1, 2023.
He argued that the termination was done in bad faith, as no reasonable justification was provided, causing him embarrassment and mental distress.
Nasir had sought a court declaration nullifying the termination letter and damages amounting to RM135,000.
This resolution marks the end of a contentious legal battle that had highlighted issues of governance and accountability within Finas.
