The Federal Court has allowed former prime minister Najib Razak and his son Nazifuddin to stay the decision which required them to pay RM1.69 billion and RM37.6 billion in unpaid taxes and penalties, respectively.
A three-judge bench chaired by the Chief Justice Tun Tengku Maimun Tuan Mat made the ruling as there was no objection the Inland Board Revenue’s senior federal counsel Al Hummidallah Idrus.
Muhammad Farhan Shafee represented Najib and his son.
The High Court on July 22, 2020 had allowed the IRB’s application for a summary judgement to be entered against Najib to recover RM1.69 billion in taxes owed between 2011 and 2017.
On July 6 the same year, Nazifuddin, 39, was ordered by another High Court pay RM37,644,810.73 in unpaid taxes to the IRB.
This followed a summary judgment entered in the IRB’s tax arrears suit seeking to recover the amount owed by Nazifuddin between 2011 and 2017.
They subsequently filed an appeal at the Court of Appeal against the court’s decision.
On Sept 9 last year, however, a three-member bench of the Court of Appeal unanimously dismissed Najib and Nazifuddin’s appeal to quash the High Court’s summary judgement against them.
The government, through the IRB, filed the suit against Najib and Nazifuddin on June 25, 2019 and July 24, 2020, respectively.
The board, on Feb 4 last year issued bankruptcy notices against the Pekan MP and his son following their failure to pay the amount owed.
